One of the big differences between buying a used car from a professional or from a private individual is the warranty. Knowing your rights before you buy avoids surprises. This information is a general guide and is no substitute for advice from a lawyer or a consumer association.

Buying from a dealership or professional

When the seller is a professional, the purchase is governed by consumer protection law. For new goods the legal warranty is two years; for second-hand goods, buyer and seller may agree a shorter period, but never less than one year from delivery when the seller is a professional. During that time, the seller is liable for defects of conformity that existed when the car was delivered to you.

What it usually covers and what it does not

The legal warranty covers defects the car already had when you received it, not normal wear from use. Items such as brake pads, tyres, wiper blades or the clutch can wear out naturally. Always ask for a written explanation of what the warranty covers for that specific car and how a claim is handled.

Additional commercial warranty

Some sellers offer extended warranties or ones provided by third parties. They are voluntary and their terms can vary a lot: duration, maximum kilometres, parts included, excesses and authorised workshops. Read the contract before signing and do not confuse it with the legal warranty.

Buying from a private seller

If the seller is a private individual, consumer law does not apply and the Civil Code governs. In practice, protection is weaker: the deadlines for claims are shorter and you will have to prove that the defect already existed when you bought. That is why it is important to inspect the car thoroughly and, if you can, have a mechanic check it before paying. Our 10-point checklist will help.

What to do if a fault appears

  • Tell the seller as soon as possible, preferably in writing and keeping proof.
  • Do not repair the car on your own without notifying them first: you could lose the right to claim.
  • Keep invoices, quotes, workshop reports and photos.
  • If there is no response, you can go to the consumer office of your region or to a consumer association.

What to ask before buying

  • How long is the warranty and from what date does it count?
  • What exactly does it cover and what is excluded?
  • Where is the car repaired if there is a fault?
  • How is an incident reported and how quickly will you get a reply?
